BOISE, Idaho (CBS2) — Bryan Kohberger has been booked into the Ada County Jail.
Kohberger is accused of killing four University of Idaho students at an off-campus home in November 2022.
His defense team has been arguing for a change of venue in the case since January of this year. Experts were brought in by the defense to help determine whether or not a fair jury could be found in Latah County.
After presenting the evidence they found, including phone surveys that found a significant percentage of the local area was familiar with the case, and Kohberger as the defendant, Judge John Judge ordered that the trial be moved to a new district.
In the written ruling issued last week, Judge Judge left the decision of which district, and what judge would preside, up to the State Supreme Court.
The Idaho Supreme Court Administrative Director issued a ruling ordering the case be moved to Ada County and appointed a new presiding judge to oversee the trial moving forward.
Kohberger's Defense team filed a flurry of motions last week, many of which are aimed at removing the death penalty as an option based on different legal briefs and standards.
Whether Judge Judge will rule on these orders or if the decision will be left up to the new presiding judge is not yet clear.
The first hearing in Ada County will occur on Thursday, Sept. 26, at 2 p.m.A court-provided livestream will be available through Judge John Judge's YouTube channel.
